"We always get drunk together," witness Rachel Bibby said she hear the woman declare on the street.

Hospital tests revealed that the boy was more than twice the legal drink-drive limit, and a statement from the witness said: "The boy was staggering around all over the place and was almost unable to stand up on his own accord. He was waving his arms in the air and fell onto the floor at one stage."

The boy, who is ten years below the legal drinking age in America and seven below that of Great Britain, is no longer allow to see his mother, who was prosecuted and pleaded guilty to child cruelty.

The Sun reported that the boy was drinking flavored vodka, which Bibby said his mother tried to take for herself.

"I saw him having an argument with his mother as she wanted the bottle of alcohol, but he refused to give it to her and continued drinking from it," she said.

The woman then bribed her son with a can of Foster's lager that she purchased at a convenient store after the argument. After refusing to drink the rest of the can, the boy's mother poured the remaining liquid over his head.

Bibby then called the police, fearing for the boy's safety.

"Unfortunately, I made eye contact with her whilst on the telephone and I heard the female clearly state in my direction 'we always get drunk together and he always acts like this,'" Bibby said.

The woman is currently facing a 12-month community service and supervision order.

"She has had a wretched life," defense attorney Paul Genney said of his client.
