Apple (NASDAQ:AAPL) may have been bruised in the stock
market, but it is stepping it up in its legal fight against Google (NASDAQ:GOOG). The iPhone maker has asked a U.S. District Court judge to force the search company to comply with a subpoena that the former hopes will help its patent lawsuit against Motorola Mobility. Google bought Motorola’s handset unit last year.
Google received the subpoena in August and was asked to hand over pertinent documents and information for a case Apple has been working on against Motorola. However, according to the iPhone maker, Google did not fully comply with the order. Having waited for months, Apple finally filed a “motion to compel compliance with a subpoena” with the U.S. District Court for the Northern District of California last week.
Apple’s case against Motorola is in a federal court in Miami and alleges patent infringement by several of the unit’s mobile phones and tablets. Some of Apple’s claims in the case also involve Google’s Android operating system, while certain others relate to Motorola’s set-top-box business, which is set to be sold to Arris (NASDAQ:ARRS) for $2.35 billion soon. According to Bloomberg, Apple’s filing also cites that impending acquisition. Specifically, the deal involves information about the valuation of Motorola’s patent portfolio, the iPhone maker’s court filing claimed.

“Apple’s subpoena to Google concerns these issues and Google’s noncompliance impairs Apple’s ability to develop its infringement and damages case against Motorola,” the filing added.
