A 60-year-old man has been accused of racially abusing and slapping a 19-month-old child on a Delta flight to Atlanta last Friday.
Joe Rickey Hundley, who was sitting in the neighboring seat allegedly demanded the mother of the crying toddler to "Shut that n****r baby up "as the flight was preparing to land in Atlanta, the Daily Mail reported Friday.
Jessica Bennett, 33, the mother of the child and her son Jonah, were on their way to a family funeral when the incident occurred.
The incident, which gained much popularity on the Internet, has left Hundley charged with simple assault, according to The Smoking Gun.
The boy's mother told the FBI that she and her toddler were seated in row 28, seat B, on Delta Flight 721 that was flying to Atlanta from Minneapolis Feb. 8, according to an affidavit filed in court in Atlanta.
The boy suffered a scratch below his right eye.
Other passengers hearing the racist slur and seeing the alleged assault, tried to come to the mother's aid, CNN has reported.
An abuse to a miner aged 16 and below entails a prison sentence of up to one year, the court papers have revealed.
Hundley, who is now president of a company that manufactures aircraft parts in Hayden, Idaho, was arrested in 2007 in a misdemeanor assault case following a fight with his girlfriend.
