Florida Therapist Arrested Over Alleged Sex With 42-Year-Old Patient: Why Is He a 'Victim'?

A Florida therapist intern has been arrested after authorities accused her of having a sexual relationship with a 42-year-old patient while he was receiving treatment at a Homestead facility.

Michelle Luchau-Rebora, 32, surrendered to authorities on 1 September after investigators accused her of engaging in sexual conduct with the patient while working as a mental health therapist intern at New Hope C.O.R.P.S., an addiction and behavioural health treatment facility on Krome Avenue. The 42-year-old was a patient and resident at the restricted facility.

An Instagram post reporting the arrest also described the man as the 'alleged victim' and stressed that the allegations remain accusations and Luchau-Rebora is presumed innocent unless proven guilty.

Therapist Accused of Sex With Patient During Therapy

According to reports citing arrest documents, Luchau-Rebora allegedly began a sexual relationship with the 42-year-old in June 2025. The relationship reportedly continued until September, with investigators alleging that sexual activity took place during therapy sessions.

Authorities also accused Luchau-Rebora of facilitating alibis that allowed the patient to leave the restricted facility so they could meet privately.

The alleged meetings took place at locations including Luchau-Rebora's home in Pinecrest, her mother's home in Key Biscayne and Jackson Memorial Hospital, according to reports citing the investigation.

Why Is the 42-Year-Old an Alleged 'Victim'?

The question centres on Florida's law governing sexual misconduct by psychotherapists.

Florida Statute 491.0112 makes certain sexual conduct between a psychotherapist and client a criminal offence. Crucially, it states that the client's consent is not a defence to the offence.

In other words, Florida law does not allow a client's consent to be used as a defence to this offence. That is why the 42-year-old can be described as an alleged victim in reporting about the case, despite authorities saying he participated in the relationship.

The law focuses on prohibited sexual conduct within the professional therapist-client relationship. This does not establish that the patient was physically forced to have sex. The available reports instead concern alleged sexual conduct involving a therapist and a person receiving professional treatment.

How the Alleged Relationship Came To Light

Investigators allege Luchau-Rebora told the 42-year-old not to disclose their relationship because it could affect her career as a therapist.

The alleged relationship came to light after Luchau-Rebora ended it and the patient reported it to the treatment facility, according to reports citing the arrest investigation. The facility then terminated her internship and notified authorities.

Authorities Alleged a Second Client Was Involved

The case was not limited to the 42-year-old patient. Authorities also said Luchau-Rebora was involved in an alleged sexual relationship with a second client. That client separately reported the alleged relationship after it ended, according to Local 10.

New Hope C.O.R.P.S. said it reported the allegations to the appropriate authorities, terminated Luchau-Rebora's internship and co-operated with the subsequent investigation.

Arrest, Bond and Current Case Status

Luchau-Rebora surrendered on 1 September and appeared before a judge on 2 September. A $5,000 (£3,694) bond was set, with a no-contact condition involving the alleged victim, according to local reports.

The allegations against Luchau-Rebora have not been proven in court. Current reporting did not establish whether she had entered a plea or retained an attorney to comment on her behalf.
