Hayden Panettiere's Ex Already Has Custody of Their Daughter: Why Is He Seeking Guardianship of Her Estate?

Hayden Panettiere's former fiancé, Wladimir Klitschko, already has custody of their daughter Kaya. So why has the former heavyweight boxing champion filed another guardianship petition following the actress's death?

The answer lies in a legal distinction between raising a child and managing their inheritance.

Klitschko, 50, filed an urgent petition in Los Angeles County Superior Court on 24 September, seeking temporary guardianship of Kaya's estate following Panettiere's death on 16 August. The 11-year-old is identified in the filing as her mother's sole heir, but her father needs separate legal authority to represent her financial interests during probate proceedings.

Why Klitschko Needs Guardianship

Klitschko has had custody of Kaya for years, and she lives with him in Ukraine. However, parental custody does not automatically grant someone the authority to administer a deceased person's estate.

Under California law, guardianship of a child's person and guardianship of their estate involve different responsibilities. The former concerns the child's care, living arrangements and welfare. The latter gives a court-appointed adult authority to manage money and property belonging to a minor.

Klitschko's petition concerns Kaya's inheritance, not a change in who raises her. His lawyers argue that the appointment would allow him to file a probate petition on Kaya's behalf and nominate someone to administer Panettiere's estate.

That administrator would require court appointment before assuming responsibility for collecting, safeguarding and eventually distributing the actress's assets. The filing describes the appointment as urgent because Kaya cannot independently exercise those legal rights as a minor.

Estate Filing Notes Missing Valuables

The request comes amid concerns about belongings at Panettiere's Los Angeles residence following her death. According to the petition, federal agents removed certain property during an ongoing investigation, while some jewellery and other personal items remain unaccounted for.

Klitschko's lawyers also allege that people previously connected to Panettiere accessed or destroyed emails. The filing states that security measures had been introduced before her death following concerns about unauthorised access to her home.

It further raises the possibility that property could be lost or misappropriated before an administrator is appointed. These are claims presented in court documents, not findings that theft or other wrongdoing has occurred. The filing does not establish who is responsible for any allegedly missing belongings.

Klitschko is seeking an authorised representative who can safeguard the estate and deal with investigators regarding property that may eventually need to be returned.

What Happens to Kaya's Inheritance Next?

Panettiere, known for her roles in Heroes and Nashville, died aged 36 on 16 August. Kaya is identified as the sole heir to her mother's probate estate, although the final value of her inheritance has not been publicly established through a completed administration.

If Klitschko's application succeeds, his appointment would allow him to represent Kaya's financial interests as the probate process moves forward. A guardian of a minor's estate is also subject to fiduciary duties, meaning the child's property must be managed for her benefit and kept separate from the guardian's personal finances.

The next court hearing is scheduled for 8 October. Until a judge rules on the petition, Klitschko's requested appointment remains pending.

The case concerns more than an inheritance dispute: it raises the question of who can legally act for Panettiere's daughter while her mother's estate is being secured and administered.
