Empire State Building Climbers Call 1,300ft Stunt a 'Celebration of Love' as They Face Court Over Viral Engagement

Ivan Kuznetsov and Angelina Nikolau, whose 1 July engagement atop the Empire State Building's spire went viral worldwide, have returned to a Manhattan courtroom to face criminal charges over the 1,300ft climb.

The pair, who documented the ascent online and later described it as a 'celebration of love', are accused of burglary, reckless endangerment and criminal mischief linked to what prosecutors say was unauthorised access to the skyscraper's restricted upper levels.

Kuznetsov, 32, and Nikolau, 33, who live in East Orange, New Jersey, were previously released under supervision.

Prosecutors allege they entered restricted areas of the landmark the night before the ascent, remained inside overnight and climbed more than 1,300ft above Manhattan to reach the broadcasting antenna by moving through a hatch and a locked security door.

Empire State Building Engagement Faces Legal Test

The couple have described the ascent as a 'celebration of love', but prosecutors allege they broke into restricted areas and damaged a security lock to reach the antenna. Authorities say a lock on a security door on the 104th floor was broken, allowing access to the broadcasting antenna.

At Monday's hearing, the case had not yet gone before a grand jury, with the pair due back in Manhattan court on 29 September.

The Empire State Building climbers are accused of entering the building on the night before the ascent and remaining inside overnight. Investigators believe they then began the climb before dawn, according to the criminal complaint.

Security cameras recorded the pair moving through a hatch on the 102nd floor at about 5am, authorities say. Officers responding to the incident were required to navigate what police described as hazardous conditions while bringing them down safely.

The alleged climb drew worldwide attention because it combined a high-altitude ascent at one of New York's best-known landmarks with a public engagement. Its legal aftermath has raised questions over alleged unauthorised access to the building's restricted upper levels.

Kuznetsov and Nikolau have portrayed the ascent as a celebration of love. In an Instagram post before their latest court appearance, they wrote: 'Whatever happens in court, we will respect the process and accept the consequences of our choices.'

Defence Disputes Risk Claims

Jason Krinsky, the couple's defence attorney, has argued that the case was overcharged. He said the stunt did not place the building's occupants or visitors at risk.

Prosecutors' account differs sharply, alleging that the pair gained access to areas not open to the public before reaching the broadcasting antenna.

The burglary and criminal-mischief allegations are linked to the claimed overnight entry and alleged damage to the security lock.

The reckless-endangerment allegation relates to the risks prosecutors say were created by the climb and the response required to bring the pair down. These allegations remain unproven, and Kuznetsov and Nikolau have not been convicted.

What the Court Will Consider

The proceedings will examine the evidence behind the allegations, including the security-camera footage, the reported broken lock and the account of officers who attended the incident. The defence is expected to challenge whether the conduct created the risk alleged by prosecutors.

Kuznetsov and Nikolau are known online for scaling skyscrapers and other prominent structures. Their established rooftop-climbing profile helped turn the Empire State Building engagement into a widely shared event.

The court case, however, focuses on the specific events of the alleged climb rather than the attention it generated online. The outcome will depend on the evidence tested through the New York criminal justice process.

The pair have not publicly detailed a response to each count in the charges cited in the report. Their Instagram statement indicates they intend to respect the court process as it continues.
