Haley Baylee's Ex Has Lawsuit Dismissed Over Influencer's Explosive Penis Size Remark

Former NFL player Matt Kalil has had his lawsuit against influencer Haley Baylee dismissed after a federal judge ruled that remarks she made about his penis size, their marriage and divorce involved information of legitimate public concern.

US District Judge Patrick J. Schiltz dismissed Kalil's complaint on 17 September, with the ruling stating that the case was dismissed with prejudice and on the merits. Kalil's lawyer has indicated that he intends to appeal.

The lawsuit stemmed from comments Baylee made during a November 2025 Twitch livestream while discussing her marriage and 2022 divorce from Kalil.

Why Did Matt Kalil Sue Haley Baylee?

Baylee, who is also known online as Haley Baylee, discussed her former marriage during a livestream with creator Marlon Lundgren Garcia.

According to the court record, Baylee said she and Kalil remained friends and described him positively before discussing an intimate issue she identified as a major factor in their divorce.

The remarks centred on Kalil's penis size and the difficulties she said the couple experienced in their sex life. The court record says Baylee compared his size to two Coke cans, possibly three, while discussing the impact the issue had on their relationship.

She also said the couple had sought help from doctors and therapists and described the experience as traumatic.

Kalil filed his lawsuit on 6 January 2026, alleging invasion of privacy and unjust enrichment after Baylee discussed intimate details of their marriage.

The court record says Kalil and his current wife subsequently received offensive messages and comments on their social-media accounts following the attention surrounding the remarks.

Why Did the Judge Dismiss the Lawsuit?

Judge Schiltz's decision focused on Minnesota's law governing the publication of private facts.

The court found that Kalil had plausibly alleged that Baylee's comments concerned his private life and could be highly offensive to a reasonable person. However, that was not the end of the legal analysis.

The central question was whether the information disclosed was of legitimate public concern. The judge concluded that it was, pointing to the circumstances surrounding Baylee's comments and the significant public and media attention they received.

The ruling also considered the context in which Baylee spoke. She was discussing her own marriage, divorce and personal experiences rather than making an unrelated disclosure about Kalil.

The decision therefore did not establish that intimate information about another person is automatically protected from a privacy claim. It applied Minnesota's legal test to the specific circumstances alleged in Kalil's lawsuit.

Haley Baylee Reacts After Lawsuit Dismissal

Baylee expressed relief following the ruling and said she hoped the decision would encourage women to speak openly about their experiences.

Her lawyer, Matthew Bialick, also welcomed the dismissal of the claims against her.

The decision came nearly nine months after the livestream that triggered the legal dispute.

Matt Kalil Plans To Appeal

Kalil's legal team has indicated that the dispute may continue through an appeal.

His attorney, Ryan Saba, told Page Six that they intend to appeal the decision. That means the September ruling may not be the final development in the case.

Kalil and Baylee married in 2015 and divorced in 2022. Kalil later remarried in 2024.
