Kim Zolciak's Son KJ Biermann, 15, Seeks Juvenile Court Transfer After Seven-Felony Indictment

Kim Zolciak and Kroy Biermann's teenage son is seeking to have his case transferred to juvenile court after being indicted on seven felony charges in Georgia. Kroy 'KJ' Biermann Jr, 15, is seeking to avoid prosecution as an adult through a legal motion filed by his defence team.

The request comes as KJ remains at the centre of a serious criminal case following allegations made by a female classmate. He denies the allegations through his legal team and is expected to enter not guilty pleas to all charges.

KJ Biermann Seeks Juvenile Court Transfer in Seven-Felony Case

KJ's legal team filed a motion on Tuesday requesting a 'transfer to juvenile court and for confidentiality proceedings', according to court documents obtained by Page Six and reviewed by IBTimes UK.

The application asks the Superior Court to move the matter into Georgia's juvenile justice system, potentially preventing him from being prosecuted as an adult.

His lawyer, Jason Sheffield, told Page Six in a statement that the defence expects to 'enter a not guilty plea to all charges' at KJ's arraignment hearing on 14 October. Sheffield said the legal team also intended to seek a transfer so that his client could be 'tried as a juvenile'.

'It is difficult to comprehend that a 14- or 15-year-old child can be held in detention for a month or longer simply waiting for a bond hearing,' Sheffield said. 'But that detention is a direct consequence of the detective's decision to arrest him on charges of this magnitude.'

If granted, the motion would move KJ's case into the juvenile justice system, where proceedings and potential consequences differ from those in adult criminal court. The court has yet to rule on the request.

What KJ Biermann Is Accused Of

KJ was arrested on 17 August following allegations of sexual assault involving a female classmate at a fitness centre in Alpharetta, Georgia, on 23 April. He was subsequently indicted by a Georgia grand jury on seven felony counts.

The charges include aggravated child molestation, aggravated sexual battery, aggravated sodomy, three counts of sexual battery against a child under 16, and false imprisonment. The indictment alleges KJ engaged in non-consensual sexual acts with a female classmate.

The alleged victim told investigators that KJ forced himself on her after she told him no while they were in a co-ed sauna, according to court documents. She said KJ made multiple attempts to have sexual intercourse with her by trying to pull down her pants.

She also accused him of forcing oral sex and digital penetration.

The alleged victim said she eventually managed to escape and reported the alleged assault the following day, after which she underwent an examination at a local hospital.

A police report noted that no male DNA was found during the examination on 24 April.

Kim Zolciak has denied the allegations, which have not been proven in court, and has defended her son through a statement to Us Weekly.

Zolciak called the allegations 'reckless and deeply troubling', adding that KJ categorically denies the claims. She also pointed to his reported polygraph results and the absence of DNA evidence.

Who Is KJ Biermann?

Kroy 'KJ' Jagger Biermann Jr is the eldest of Kim Zolciak and former NFL player Kroy Biermann's four biological children. He has five siblings in the family's blended household: older sisters Brielle and Ariana, younger brother Kash, and younger twin siblings Kaia and Kane.

Kroy legally adopted Brielle and Ariana, Kim's daughters from previous relationships, in 2013. KJ and his siblings grew up in the public eye, appearing alongside their parents on The Real Housewives of Atlanta and the family's Bravo spin-off Don't Be Tardy.

Kim and Kroy married in November 2011, but their relationship later became the subject of a lengthy divorce dispute. The pair first filed for divorce in 2023, briefly attempted to reconcile, and then resumed divorce proceedings later that year.

Their divorce proceedings remain ongoing. The family's highly public personal disputes remain separate from the criminal case now facing their eldest son.
