Marine veteran and Senate candidate Brian McGinnis faces charges after a chaotic removal from a Senate hearing, sparking a political row.

North Carolina Senate candidate Brian McGinnis is facing a severe legal battle following his forcible removal from a Senate Armed Services subcommittee hearing on 4 March 2026.
McGinnis, a 44-year-old Marine veteran and Raleigh firefighter, was arrested after interrupting testimony on military readiness to protest US involvement in the Middle East.
The confrontation turned physical when Senator Tim Sheehy (R-MT), a former Navy SEAL, left his seat to assist Capitol Police in wrestling McGinnis from the room, as Video footage showed him shouting, 'No one wants to fight for Israel.' The clip also captured a sickening 'snap' of McGinnis's arm, which was caught in a doorway during the struggle, an injury his campaign team confirms is a major fracture.
McGinnis has been charged with seven counts, including multiple felonies for assaulting law enforcement. While his supporters label him a 'patriot' and the victim of excessive force, Capitol Police maintain his 'violent resistance' caused injuries to three officers.
He had posted from Capitol Hill earlier that day, saying he wanted to ask the Senate why it was prepared to send US service members into harm's way.

Brian McGinnis And The Capitol Clash
The scene itself was abrupt and messy, the sort of Washington moment that looks even worse on replay. CBS reported that McGinnis, dressed in a military uniform, began shouting less than 30 minutes into the hearing, and the Capitol Police officers moved to remove him after he interrupted proceedings with objections to the US and Israel's war with Iran.

The CBS video shows officers already wrestling with McGinnis when Sheehy left the dais and moved in to help near the doorway. As the group tried to force him out, McGinnis clung to the door, and his left hand appeared to become trapped between the door and the frame, a detail that turned an already ugly removal into something more serious.
There is no shortage of accusations in the official version. The Capitol Police (USCP) said McGinnis faces three counts of assaulting a police officer, three counts of resisting arrest and one count of crowding, obstructing and incommoding, which in this case meant allegedly blocking an entrance or passageway during the hearing.
The force also said he 'put everyone in a dangerous position by violently resisting' officers and later claimed he 'got his own arm stuck in a door' while trying to force his way back into the room. Police added that three officers were treated for injuries by local emergency medical services.
Sheehy has been equally direct. In a post on X, the Montana Republican said McGinnis was 'fighting back' and that he stepped in to 'help out and deescalate the situation,' later describing him as a man who 'came to the Capitol looking for a confrontation.' His office did not immediately respond to a further request for comment, according to CBS.
What Brian McGinnis Says Happened
McGinnis and his supporters tell a sharply different story, one that hinges on injury rather than aggression. Shortly after the clash, he said his left arm was broken, while Mark Elbourno, the Green Party official managing his Senate campaign, told CBS that McGinnis had been arrested and taken to George Washington University Hospital.
Elbourno flatly rejected the allegation that McGinnis assaulted officers. 'He wasn't assaulting anybody,' he told CBS, adding that McGinnis 'was assaulted' and that 'they broke his arm.' That does not settle the matter, of course, but it does underline the central point that remains contested, namely, whether McGinnis was violently resisting or whether the force used to remove him crossed a line.
The footage, at least as described in the reporting now available, leaves room for argument rather than much certainty. Somebody can be heard accusing Sheehy of breaking McGinnis' hand, and when another person later asked McGinnis whether his hand was okay, he answered, 'No, it's not'. Outside the room, he was heard saying his left arm was broken.
